This Disclaimer governs all services provided by Hostrare Limited, including Domain Registration, Web Hosting, Dedicated & Cloud Servers, Software Development, Website Development, and Mobile Application Development. By engaging with our services, you acknowledge and agree to the following:


1. General Service Disclaimer

  • All services are provided on an “as-is” and “as-available” basis.

  • Hostrare Limited makes no warranties or guarantees of uninterrupted service, error-free performance, or absolute data security.

  • We reserve the right to suspend, modify, or discontinue any service, with or without prior notice, due to operational, legal, or security reasons.


2. Force Majeure & Third-Party Dependency

Hostrare Limited shall not be held responsible for interruptions, delays, or failures caused by:

  • Fiber optic/cable disruptions, submarine cable faults, or BTCL/local infrastructure issues

  • Satellite interference, network congestion, or upstream provider outages

  • Cyberattacks (DDoS, hacking, phishing, malware) beyond reasonable control

  • Natural disasters, pandemics, government restrictions, or regulatory interventions

  • Third-party service failures (such as ICANN registries, cloud providers, data centers, or API dependencies)


3. Domain Registration & Management

  • Domain availability and ownership are subject to registry/ICANN rules. We cannot guarantee successful registration until confirmed by the registry.

  • Failure to renew on time may result in domain loss, deletion, or auction by the registry. Hostrare Limited is not liable for expired or lost domains due to late payments.

  • Disputes are handled under ICANN’s Uniform Domain-Name Dispute-Resolution Policy (UDRP) or relevant registry policies.

  • Country-code domains (e.g., .bd, .uk, .in) are subject to local regulations of respective authorities.


4. Hosting & Server Services

  • We strive for 99.9% uptime (industry standard) but cannot guarantee uninterrupted service.

  • Clients are solely responsible for regular backups. While Hostrare Limited may provide backup options, we are not liable for loss or corruption of data.

  • Misuse of hosting (spam, phishing, illegal content, resource abuse, crypto-mining, etc.) will result in immediate suspension or termination without refund.

  • Security patches and updates are applied as part of routine maintenance, but zero-day vulnerabilities may still impact service.


5. Software, Website & Mobile App Development

  • Deliverables are based on agreed project scope. Any post-delivery modifications or new requirements will be treated as change requests and may incur additional charges.

  • Hostrare Limited does not guarantee compatibility of software/applications with all devices, OS versions, or browsers unless explicitly stated in the contract.

  • Any third-party libraries, frameworks, or APIs used in the project are subject to their respective providers’ terms. Failures or changes from third-party providers are outside Hostrare Limited’s liability.

  • Intellectual Property (IP) rights of custom software will remain with the client only upon full payment unless otherwise agreed.


6. Data Privacy & Security

  • Hostrare Limited implements industry-standard security practices, but no system is 100% secure.

  • Clients are responsible for protecting their credentials, API keys, and account access.

  • We are not liable for breaches caused by weak client-side security, third-party tools, or end-user negligence.


7. Compliance & Acceptable Use

  • Clients must comply with local and international laws, including but not limited to:

    • GDPR (for EU data subjects)

    • CCPA (for California consumers)

    • IT/Telecom Act of Bangladesh

    • Anti-spam, anti-piracy, and anti-money laundering regulations

  • Hosting or distributing illegal, abusive, or harmful content is strictly prohibited.


8. Limitation of Liability

  • Hostrare Limited shall not be liable for direct, indirect, incidental, or consequential damages including but not limited to business loss, data loss, reputational damage, or financial loss.

  • Our maximum liability under any claim is limited to the fees paid for the specific service during the claim period.


9. Support & Maintenance

  • Standard support is provided as per the service-level agreement (SLA).

  • Emergency response and premium support may incur additional charges.

  • Resolution times are based on best-effort basis, subject to complexity and third-party dependencies.


10. Policy Updates

Hostrare Limited reserves the right to update or revise this Disclaimer Policy at any time. Updates will be effective immediately upon publication on our website. Clients are responsible for reviewing this policy periodically.
